I find this to be a fascinating and quite perplexing subject. I first started hearing about this when I became a member of NSAI (Nashville Songwriters Association International) back in the mid '90's where I first learned about BMI and ASCAP. It doesn't make sense to me. Why aren't entities like BMI and ASCAP up in arms about this. I would think these guys along with several big name artists from varying genres would be making highly publicized lobbies to congress to amend or completely repeal Safe Harbor. What is the incentive for a fledgling artist to enter the entertainment business? And how much untold revenue is being lost by veteran artists? Are they forced to make their living solely from ticket sales of endlessly touring? One other question that may be naive: Is this the reason artists like Garth Brooks and ACDC (until recently) would not allow their music to be sold on iTunes?
